Preamble

The current General Terms and Conditions aim to define the rules applicable in the context of the sale of products (hereinafter "the Product (s)") on the Website, Corner Parisien, the firm Corner Parisien by Elsa Kahan, registered with the Federal Commercial Registry Office of Switzerland, whose headquarters is located at 8008 Zurich, Switzerland, acting under the trade name of Corner Parisien in Switzerland, and the firm Corner Parisien LTD, registered with the Companies House, whose headquarters is located London, United Kingdom, acting under the trade name of Corner Parisien in the rest of the world.

And

Any adult individual, non-vendor, having the capacity of legal contract, exclusively residing in one of the countries delivered to by http://www.cornerparisien.com (hereinafter "Customer") purchasing products on the Website. For purposes hereof, it is agreed that Corner Parisien and the Customer will be referred to collectively as the "Parties" and individually as the "Party". The General Terms and Conditions (hereinafter "General Terms and Conditions") govern without restriction the sales of Products by the Corner Parisien from the Website. Corner Parisien reserves the right to change at any time the current General Terms and Conditions by posting a new version on the Website. The General Terms and Conditions are applicable and enforced on the Website at the time the order is placed by the Customer; precisely, that all orders placed on the Website imply full and complete adherence by the customer to the General Terms and Conditions enforced at the moment the order is placed.

Article 1 • Purpose

The current General Terms and Conditions aim to define the conditions in which the products are commercialized by Corner Parisien to the Customer. They regulate the different steps of the sale process and the commissioning of the order by the Customer.

Article 2 • Products

The Products offered for sale by Corner Parisien are those listed on the Website on the day of its consultation by the Customer. Every Product will be the subject of a descriptive page which, in addition to photography, contains: the price, images, sizes and colors available, components, and particular characteristics as well. Minor differences between products and photographs may exist, especially depending on the resolution and color definition of the screen of the user.

Article 3 • Price

Prices are quoted in Swiss francs CHF includes ALL taxes, except shipping costs; specifically given that the tax on value added is that which is applied on Swiss territory for Swiss Sale and United Kingdom for the rest of the countries, on the date of the confirmation of the order. The prices applied are those communicated on the Website and confirmed to the customer during validation of the order. The shipping costs are communicated to the Customer on the summary of the order before the validation of the order and all included taxes are stated. These fees are the responsibility of the Customer and are billed in addition to the selling price of products. The transfer of risk of loss and/or the deterioration of the Products will become effective after the delivery and receipt of the Products by the Customer. We reserve the right to modify our prices at any time, but we commit ourselves to apply the prices indicated on the website at the time of your order. We will inform you in the case of an incorrect price display, which is obviously ridiculous (extremely cheap), whatever the reason (computer bug, manual error, technical error.), the order–  also validated by us – will be canceled, of which we will inform you as soon as possible. So you will be able, if you wish, to reorder at the correct and exact price.

Article 4 • Ordering and Payment 

• 4.1 Placing an order

The Customer places an order by completing the next 5 steps:

Step 1: The Customer selects the desired products and adds them to his or her basket after having selected the desired size and color.

The basket, located on the top right of the screen, informs the customer that it tooks into account the selections by indicating the number of products that it contains.

Step 2: The Customer verifies the contents of his or her basket by clicking on "order" to have access to the summary of the order. The customer may then modify his or her order (Product, size, quantity).

The total amount, including taxes, is then indicated in the summary, excluding shipping costs. The customer is then invited to login to his/her account. Apart from the date of birth, the additional address, and the shipping information, all fields are required to finalize the order; unless otherwise stated by the Customer, the billing address will be automatically the same as the delivery address.

If the Customer has already placed an order on the website, the Customer has an account. In such case, the Customer will login using his or her email address and password.

The customer then verifies all information and clicks on "submit" to continue placing the order.

Step 3: Once the order is modified, if necessary, and verified, and the Customer’s account signed into, the Customer is invited to verify the delivery address as well as the billing address indicated during the creation of the Customer’s account. The Customer may update this information if necessary. The Customer then verifies all of the information and clicks on "order" to continue the order.

Step 4: The Customer selects the delivery mode. The customer can choose between different delivery modes and delivery times. Once the choice is made, delivery charges will be displayed including taxes. This amount is added to the total amount of the order, including taxes, and excluding any total or partial discounts on the delivery charges the Customer may have received.

Step 5: Entering the payment information.

The Customer will then access the secure payment screen of the Corner Parisien partner, PostFinance,or Hipay as specified in Article 4.3 below.

Online payment is made by credit card only.

The customer will enter their credit card number, expiration date as well as the 3 digits of the security code on the back of the card, in the case of payment by American Express card, the customer will enter the 4-digit security code.

If the payment is accepted, the customer will be redirected toward an order confirmation screen on the website.

In the case of failure of payment, the customer will be allowed 3 additional attempts to enter his or her credit card information. After the third refusal, the customer will be redirected on the Website toward a screen indicating that his or her payment was refused. The customer will then be invited to contact the Corner Parisien customer service in order to find out the reason(s) why the payment was refused and to find a joint solution to finalize the Customer's order.

• 4.2 Confirmation of Order

Once the payment is accepted, the Customer will receive an email confirmation of the order summarizing all of the items ordered, billing and delivery address, and the delivery method. The acceptance of the order by the Customer and the order confirmation, sent to the Customer via email by Corner Parisien after accepting the payment, indicate a conclusion of sale agreement between the Parties and acceptance of the General Terms and Conditions. The Customer who placed the order will be able to print the invoice by logging onto the Website in the customer section created for this purpose. Corner Parisien reserves the right to not process any order in the case of: abnormal or abusive claims, abnormal orders with regard to quantities ordered, abnormal or improper returns or exchanges, existing dispute(s) with the customer. The Corner Parisien customer service Website is made available to the Customer for any questions related to the order.

• 4.3 Payment

The price of the Product purchased is payable in cash, in totality on the day the Customer’s order is placed. The payment is done online by credit card (Visa / MasterCard /Postcard) or by PayPal at the time of the validation of the order by the customer. The debit authorization request is effected at the time of the confirmation of the order on the Website, except in the case of unavailability of servers. Corner Parisien reserves the right to proceed to a new debit authorization request in the case of the first not having succeeded because of the unavailability of servers. In the case of a non-payment, a wrong address or any problem on behalf of the Customer’s account, Corner Parisien reserves the right to block the Customer's order until the resolution of the problem. In the case of fraudulent use of a credit card on the Website, the Customer is invited to contact the Corner Parisien Customer service, using their telephone number (cost of a local call) from Monday to Friday from 9 am to 7 pm or via e-mail to the following address: contact@cornerparisien.com. Corner Parisien implements all necessary means to ensure confidentiality and security of the banking information transmitted on the Website. The Website is provided with a system of online payment security in order to encrypt your banking information. The payment information is transmitted according to the highest safety standards. The transmission of your banking information is guaranteed by our partner. All of the information exchanged to remit payment are encrypted according to SSL (Secure Socket Layer) protocol. This information can be neither detected nor intercepted, nor used by third Parties. At no moment does any customer financial data pass on the computer system of Corner Parisien. Our partner has verified that the connection with browser Customers is secured before sending the payment form to the bank performing the financial transaction.

• 4.4 Archiving the Order

The order confirmation is registered on the Corner Parisien servers, which are supported on a reliable and durable connection. The customer accepts that the order confirmation is considered as a proof of the contractual relationship intervened between the Parties.

Article 5 • Delivery

All orders are subject to stock availability and initial security checks.

We dispatch all Standard Delivery orders within 48 working hours. During sale periods or bank holidays, deliveries may take longer. If you've not received your delivery within 10 working days, please contact our customer care team with your name and order number – the team will be happy to help within 2 days. Please note, Standard delivery service cannot be tracked.

Regarding furniture, most of our items are delivered within a month (for big items, check delivery time on product page) and we may ask that extra postage is paid, shipped with DPD.

Corner Parisien will deliver the orders with an invoice in a maximum period of ten (10) business days for a delivery to Switzerland, and the UK and twenty (20) business days for a delivery to any other destination, and this includes the day following the payment of the order, except for products where a special delivery time is mentioned. When ordering furniture, shipping fees may be applied. For other destinations, shipping costs will be considered part of the estimate once the order is placed. Any order registered on the Website from Monday to Friday before 2 pm will be processed within 2 days. Any order placed on Friday after 2 pm or on Saturday or Sunday, will be treated the following Monday; Orders placed on a holidays will be processed within 3 business days. In the case of the delivery time surpassing this timeframe, not justified by a case of force majeure, the customer will request the cancellation of the sale and receive with a maximum delay of 30 (thirty) days the reimbursement of the amount paid during the sale. The overrun delivery time may not give rise to damages or interest. For orders outside Switzerland or Europe when the package destined to exportation reaches its destination, it will be the responsibility of the recipient to pay taxes or duties applied in the destination country. It may happen that your order will be ship from both our two warehouses (LONDON and ZURICH) in that case you could have to pay taxes or duties. Local authorities may guide you in this process. If exceptionally, the articles ordered are no longer available, the customer will either proceed to an exchange, or be refunded without delay at most within thirty days of the payment of the original amount paid by the Customer.

Article 6 • Reception of Order– Claims

The Customer must check that the Products received conform to his or her order at the time of delivery.

• 6.1 Malfunction

Any malfunction concerning the delivery such as damaged package, missing products, damaged, defective products in the order, shall be signaled within a maximum of three (3) days of receipt of the order. This notification will be sent to the Corner Parisien Customer service site via email to the following address: contact@cornerparisien.com. Any claim beyond the 3 (three) days after delivery will not be accepted.

The absence of complaints, or non-expression of reservations by the Customer means that the item delivered is deemed satisfactory and will not be subject to subsequent dispute. For any return of non-conforming Products, the Customer must comply with the following procedure:

- Customer contacts Customer service to inform them of the concern - according to the problem with the order, Customer service will send the customer a prepaid return label to allow the Customer to return the product at no charge by the applicant at the La Poste or by giving it to another carrier when appropriate.

- Products must be returned in their original packaging and in the packaging that protects the product against deterioration, with the label and any accessories intact so that they may be remarketed, to the following address, when non-compliance has been found, Corner Parisien will offer the Customer reimbursement of the price of the order (price of products and shipping costs) as well as the return costs of the non-compliant Product, at the latest within thirty (30) days from the date the notification of non-compliance was sent via the customer service site of Corner Parisien. In the case of a refund, Corner Parisien ensures repayment of all products made in compliance, as well as shipping costs, excluding taxes and customs duties paid by the customer upon delivery. Returns against refunding are not accepted. Upon receipt of a non-conforming article, Corner Parisien supports the reimbursement of postal return costs in the amount of the fee schedule (delivery without LaPoste recommended) displayed by La Poste on March 1st of the current year. The Customer must send proof of return costs incurred to Customer service via email. If abnormal or abusive claims are made, Corner Parisien may refuse to process a future order.

Article 7 • Reimbursement

The Customer has a period of ten (10) business days from the date of receipt of the order to return the Products ordered, without justification or penalty. For any return for a refund, the following procedure should be fully respected:

-The Client will connect to his or her account and request a return

-Once the return is validated by customer service, the Customer is invited to return the product(s)

-The Products must be returned in their original packaging, with labels and accessories

-Once the return is received by Corner Parisien, the product(s) are verified and approved, and the refund will be processed. Risk and return costs are the sole responsibility of the Customer, a tracking number may be asked.. Subject to the conditions above, Corner Parisien will refund the amount of the order including tax to the Client, excluding return costs and delivery. In the case that free delivery has been offered by Corner Parisien, the Customer must pay the shipping charges. In the case of a partial return of an order, in which the order’s initial amount warranted free shipping, shipping charges for the items kept by the Customer will be deducted from the amount reimbursed by Corner Parisien, to cover the costs of shipping these items. The Client's bank account will be credited such amount within thirty (30) days of receipt of the Corner Parisien Product(s). We don’t operate an exchange service. If you want to order an item in a different size, a different design or another colour, just place a new order in our online shop.

Article 8 • Personal Data

Corner Parisien collects the information necessary to process orders. These data are not only required to process the Customer’s order by Corner Parisien, but also to communicate information about the Corner Parisien brand to the Customer, information about the Website or to offer the Customer promotional offers for Corner Parisien; if the customer accepts this when validating his or her order. This information is strictly confidential and is identified by an asterisk (*) when necessary for Corner Parisien, and/or its contractors in connection with the management of the Customer’s order. Following any injunction or legal authorities to defend its rights or those of its employees, customers or any other person, Corner Parisien will communicate these data to the bodies and authorities legally empowered. Corner Parisien is committed to taking every precaution to ensure the safety of its files and protect its computer system, and in particular to prevent personal customer information from being distorted, damaged or allowing unauthorized parties have access. Customers’ personal information is sent and stored in the web host located in Switzerland, including the coordinates listed on the website under "Legal Information". The Customer has a right to access, rectify, modify and delete personal data. The Customer may exercise this right by writing to the following address, stating your full name, email and postal address:

Corner Parisien Customers may also change personal details in the Customer section of the Website by identifying themselves with their email address and their password.

To send the Client the Corner Parisien newsletter, Corner Parisien uses an opt-in process (membership optional), that is to say, Corner Parisien sends a newsletter via e-mail if the Customer has previously and expressly confirmed that he or she wishes to subscribe to the newsletter service. If the Customer does not want to receive the newsletter, he or she reserves the right to terminate this service at any time, as each newsletter contains a link to unsubscribe. The Customer may also later request that Customer service reactivate his or her subscription to the newsletter.

Article 9 • Cookies

To process the Customer’s order, and in order to better understand customer needs and customize the services offered on the Website, Corner Parisien uses cookies. A cookie is a file stored on the hard disk of the Customer’s computer that reports the Customer’s path on the Website. Cookies capture: the Customer’s time visiting the Website, its identity (known thanks to his email address and password) and the contents of his cart. Once disconnected from the Website, this information is stored for 30 (thirty) days before being permanently deleted. Customer may oppose the registration of cookies by configuring their browser. They then lose any customization of the service that it is offered on the Website.

Article 10 • Limitation of Liability

Placing an order on the Website implies knowledge and acceptance of procedures of the Internet network, in particular as regards technical performance, response times, connection, questions or transfers of information, the risk of losing the connection, the risk of contamination by viruses circulating on the network and in general all of the risks associated with the use of the Internet. Corner Parisien therefore is not in any event liable for any direct or indirect damage resulting from misuse or incidents related to the use of the computer for Internet access, maintenance or malfunction of servers, telephone line or any other technical connection, the Customer’s connection to the Website is entirely the Customer’s responsibility.

Article 11 • Force Majeure

Corner Parisien will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if such non-performance is caused by an event of force majeure as defined by substantive law. In such an event, customer service will inform the Customer of the occurrence of such an event within 3 (three) days following its occurrence, by email. After a period of 1 (one) month, and assuming that an event constituting force majeure persists, the order will be canceled and will, where appropriate, be subject to reimbursement by Corner Parisien on the credit card used when placing the order within a maximum of 30 (thirty) days.

Article 12 • Legal Right of images and text

All legal rights of images, sounds and text used on the Website are owned by Corner Parisien or its respective partners. Any use without our expressed consent is strictly prohibited.

Article 13 • Applicable law

If any of the terms of these General Terms and Conditions are found invalid, illegal or unenforceable by a court decision, the remainder of these General Terms and Conditions shall remain enforced. The General Terms and Conditions are executed and interpreted according to Swiss law in Switzerland and UK law in the rest of the world. In the case of a legal dispute, the Customer will be contacted by Corner Parisien, with priority, in order to reach an amicable solution.

These General Terms and Conditions take effect from May 1, 2016. Corner Parisien reserves the right to modify certain elements of these General Terms and Conditions over the course of the year.
